Introduction

  1. At its meeting on 8 December 2021, the Education, Children and Young People Committee considered SSI 2021/379: The Protection of Vulnerable Groups (Scotland) Act 2007 (Applications for Removal from List and Late Representations) Amendment Regulations 2021 which is subject to the negative procedure. This report sets out the Committee's consideration of the instrument.


Instrument Overview

  1. SSI 2021/379: The Protection of Vulnerable Groups (Scotland) Act 2007 (Applications for Removal from List and Late Representations) Amendment Regulations 2021 was laid before Parliament on 1st November 2021.

  1. The policy note can be accessed here. The purpose of the instrument is to enable individuals, who are barred from carrying out “regulated work”i when aged between 18 and 25 years, to apply to be removed from the barred list sooner.

  1. The instrument was considered by the Delegated Powers and Law Reform Committee (DPLRC) at its meeting on 9 November 2021. The DPLRC had no comments to make on the instrument; its report is available here.


Education Children and Young People Committee

  1. At the Committee's meeting on 8 December 2021, Meghan Gallacher MSP moved motion S6M-02353— That the Education, Children and Young People Committee recommends that the SSI 2021/379: The Protection of Vulnerable Groups (Scotland) Act 2007 (Applications for Removal from List and Late Representations) Amendment Regulations 2021 be annulled.
