The UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020

Introduction

  1. The Culture, Tourism, Europe and External Affairs Committee reports to the Parliament as follows—

  1. The UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 were laid before the Parliament on 17 February 2020 and referred to the Culture, Tourism, Europe and External Affairs Committee for consideration.

  1. The purpose of these regulations is to help ensure successful delivery of the Union of European Football Associations (UEFA) European Football Championship (the Championship) which will be hosted, in part, in Glasgow in summer 2020. The regulations do this by enabling the commitments required by UEFA in relation to protection of commercial rights for event sponsors during the period of the event to be met.

  1. The policy note states that the regulations set out what trading consists of and prescribe the circumstances for which exceptions to the trading and advertising offences will apply. They also include maps of the three event zones where the restrictions will apply and when each event zone will be in operation.


Consideration by the Committee

  1. The Delegated Powers and Law Reform Committee considered this instrument at its meeting on 3 March 2020 and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. At its meeting on 12 March 2020, the Culture, Tourism, Europe and External Affairs Committee took evidence on the instrument from—

    • Ben Macpherson, Minister for Public Finance and Migration; and

    • Lucy Carmichael, Bill Team Leader, Scottish Government

  1. During the discussion on the instrument, Committee members questioned the Minister on issues such as whether the Scottish Government has received feedback from businesses on the illustrative regulations published during the passage of the UEFA European Championship (Scotland) Act 2020; the operation of charity workers in event zones and what constitutes a controlled way these workers operate; what engagement the Scottish Government, Glasgow City Council and Glasgow Life has had with businesses in the event zones; and Euro 2020 product categories.

  1. The Minister confirmed that the Scottish Government had received such feedback and had also heard from some businesses that the impact of these changes would be "minimal". The Minister told the Committee that any charity collector who had been granted permission by Glasgow City Council under the Civic Government (Scotland) Act 1982 would be allowed to collect within the three event zones.

  1. In relation to businesses situated within the three event zones, the Minister confirmed that there had been "significant engagement" had taken place, including drop-in sessions which provided an opportunity for businesses and traders to ask questions about the restrictions. The Scottish Government also updated stakeholders when the regulations were laid in order to keep them informed of the process.

  1. Following the discussion, the Minister moved motion S5M-21118—

    "That the Culture, Tourism, Europe and External Affairs Committee recommends that the UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 [draft] be approved."

    The motion was agreed to without division.


Conclusions

  1. The Culture, Tourism, Europe and External Affairs Committee recommends that the UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 be approved.
