Criminal Justice Committee
At its meeting on Wednesday 22 January 2025, the Criminal Justice Committee ("the Committee") considered the following instrument:
The purpose of the Order is twofold. Firstly, to amend the International Organisations (Immunities and Privileges) (Scotland) Order 2009 (“the 2009 Order”) by adding a new schedule 21 to confer privileges and immunities in accordance with the Host Country Agreement between the Government of the United Kingdom and the European Forest Institute.
Secondly, to add a new schedule 22 to confer privileges and immunities in accordance with the Convention between the Government of the Italian Republic, the Government of Japan and the Government of the United Kingdom establishing the Global Combat Air Programme International Government Organisation.
Additionally, the Order amends paragraph 7(5) of schedule 15 of the 2009 Order to correct an erroneous cross-reference.
The DPLR Committee considered the instrument on Tuesday 7 January 2025 and reported on it in its 1st Report, 2025. The DPLR Committee made no recommendations in relation to the instrument
However, it welcomed that the instrument fulfils a commitment made by the Scottish Government to correct an error in the International Organisations (Immunities and Privileges) (Scotland) Order 2009 which arose from an error in the International Organisations (Immunities and Privileges) (Scotland) Amendment Order 2024 (SSI 2024/158).
Motion S6M-15946 was lodged proposing that the Committee recommends approval of the instrument. At its meeting on Wednesday 22 January 2025, the Committee took oral evidence from the Cabinet Secretary for Justice and Home Affairs, Angela Constance MSP ("the Cabinet Secretary").
During the evidence session, the Cabinet Secretary outlined the purpose of the Order to the Committee, as set out above.
There being no questions from Members, the Cabinet Secretary moved the motion:
