It is fair to say—the Solicitor General will make this comment when she winds up—that even if there had been the best early-warning system, no one thought that this case would bring about this result. If the definition is "a large number", we will never know how many that is until it is tested case by case, not at commissioner level—the commissioners have been quite happy, although we do not know the standard that Lord whatever applied to a large number—but in court.
