Health and Care (Staffing) (Scotland) Bill 9 Part 3—Staffing in care services (11) In Part I of the schedule— (a) in column 1— (i) after the entry relating to section 10(4) of the National Health Service (Scotland) Act 1978, insert “Section 12IA”, 5 (ii) after the entry inserted by sub-paragraph (i), insert “Section 12IB”, (iii) after the entry inserted by sub-paragraph (ii), insert “Section 12ID”, (iv) after the entry inserted by sub-paragraph (iii), insert “Section 12IE”, and (v) after the entry inserted by sub-paragraph (iv), insert “Section 12IF”, and (b) in column 2— 10 (i) in the place corresponding to the entry inserted by paragraph (a)(i), insert “Duty to ensure appropriate staffing”, (ii) in the place corresponding to the entry inserted by paragraph (a)(ii), insert “Duty to follow common staffing method”, (iii) in the place corresponding to the entry inserted by paragraph (a)(iii), insert 15 “Duties of training and consultation of staff”, (iv) in the place corresponding to the entry inserted by paragraph (a)(iv), insert “Duty of reporting on staffing”, and (v) in the place corresponding to the entry inserted by paragraph (a)(v), insert “Duty to have regard to Ministerial guidance on staffing”. 20 (12) In Part II of the schedule— (a) in column 1, at the end, insert “Section 2 of the Health and Care (Staffing) (Scotland) Act 2019”, (b) in column 2, in the place corresponding to the entry inserted by paragraph (a), insert “Duty to have regard to guiding principles in health care staffing and 25 planning”.

General 17 Power of Scottish Ministers to make arrangements for certain functions (1) The Scottish Ministers may make arrangements for a person to perform some or all of their functions under this Part. 35 (2) Subsection (1) does not include any power of the Scottish Ministers to make regulations under this Part. 9 Fireworks and Pyrotechnic Articles (Scotland) Bill Part 3—Restrictions on supply and use of fireworks and pyrotechnic articles (3) The making of arrangements under this section to perform a function does not— (a) affect the Scottish Ministers’ responsibility for the performance of the function, or (b) prevent the Scottish Ministers from performing the function. 5 18 Power to make further provision (1) The Scottish Ministers may by regulations make further provision for the purposes of this Part. (2) Without limiting the generality of subsection (1), regulations under that subsection may make provision— 10 (aa) about the verification of applications and supporting documents, 1 (b) about the sharing of information (for example, in connection with the verification of applications or the enforcement of this Part). (3) Regulations under subsection (1) are subject to the affirmative procedure. 19 Regulations: consultation 15 (1) Before making any regulations under this Part, the Scottish Ministers must consult such persons as they consider are likely to be interested in or affected by the licensing of fireworks. (2) Subsection (1) does not apply to regulations under section 3.

Interaction with provision for other parts of the United Kingdom 94V Relationship between this Part and UK provisions (1) The Scottish Ministers may by regulations modify this Part to make provision about the relationship between this Part and the relevant UK provisions in 40 circumstances where both this Part and the relevant UK provisions apply to a 47 Social Security (Amendment) (Scotland) Bill Part 7—Recovery from compensation payments payment to or in respect of any individual in consequence of any accident, injury or disease suffered by that individual. (2) In this section— “injured person’s address” means the address first notified in writing to 5 the compensator by or on behalf of the injured person as that person’s residence or, if the injured person has died, by or on behalf of the person entitled to receive the compensation payment as the injured person’s last residence, “relevant UK provisions” means— 10 (a) where the injured person’s address is in Northern Ireland, any 1 enactment making provision corresponding to this Part (or about the application of this Part) and having effect in Northern Ireland, (b) where the injured person’s address is in England or Wales, any enactment making provision corresponding to this Part (or about 15 the application of this Part) and having effect there. (3) Any reference in this section in relation to the relevant UK provisions to— (a) the compensator means a compensator within the meaning of those provisions, (b) the injured person means an injured person within the meaning of those 20 provisions, (c) the compensation payment means a compensation payment within the meaning of those provisions. 94W Recovery of payments due from compensator (1) The Scottish Ministers may by regulations modify this Part to make provision 25 about the recovery of payments due from a compensator in circumstances where— (a) the relevant UK provisions apply to a payment to or in respect of any individual in consequence of any accident, injury or disease suffered by that individual, and 30 (b) immediately before making a compensation payment the compensator— (i) is not resident and does not have a place of business in a part of the United Kingdom other than Scotland, but (ii) is resident or has a place of business in Scotland. (2) In this section— 35 (a) “relevant UK provisions” has the same meaning as in section 94V, (b) any reference in this section in relation to the relevant UK provisions to— (i) the compensator means a compensator within the meaning of those provisions, 40 (ii) the compensation payment means a compensation payment within the meaning of those provisions.”. 48 Social Security (Amendment) (Scotland) Bill Part 7—Recovery from compensation payments (3) After schedule 11 insert— “SCHEDULE 12 (introduced by section 94A(2)) C OMPENSATION PAYMENTS 5 P ART 1 E XEMPTED PAYMENTS 1 Any payment made to or for the injured person under— (a) section 249 of the Criminal Procedure (Scotland) Act 1995, (b) section 130 of the Powers of Criminal Courts (Sentencing) Act 2000, 10 (c) section 175 of the Armed Forces Act 2006, 1 (d) section 8 of the Modern Slavery Act 2015, (e) Chapter 2 of Part 7 of the Sentencing Act 2020, 2 Any payment made in the exercise of a discretion out of property held subject to a trust in a case where no more than 50% by value of the capital contributed 15 to the trust was directly or indirectly provided by persons who are, or are alleged to be, liable in respect of— (a) the accident, injury or disease suffered by the injured person, or (b) the same or any connected accident, injury or disease suffered by another person. 20 3 Any payment made out of property held for the purposes of any prescribed trust (whether the payment also falls within paragraph 2 or not). 4 (1) Any payment made to the injured person by an insurer under the terms of any contract of insurance entered into between the injured person and the insurer before— 25 (a) the day on which the injured person first claims assistance in consequence of the disease in question, or (b) the occurrence of the accident or injury in question. (2) In this paragraph, “insurer” means a person who has permission under Part 4A of the Financial Services and Markets Act 2000 to effect or carry out 30 contracts of insurance.
