There has been no material change to the legislation that would require a re-issue of the code, however, the Scottish Government has taken the opportunity to strengthen the code, which makes more comprehensive and enhanced guidance available to proper persons.
The Committee welcomes the provisions in the Land Reform (Scotland) Act 2016 in relation to the Code of Practice but is concerned that the Code has been insufficient in influencing all DMGs.

Code of Conduct Rule changes- Treatment of Others
A report to Parliament recommending Code of Conduct Rule changes in relation to the treatment of others.
In Scotland, the First Minister is the only MSP who assesses and decides action for a breach of the ministerial code. All MSPs, including ministers, are expected to abide by the “Code of Conduct for Members of the Scottish Parliament”.
Codes of Practice
Two Codes of Practice are issued under FOISA (by Scottish Ministers) to provide guidance to public authorities on responding to requests for information and associated matters (section 60 Code of Practice) and on records management (section 61 Code of Practice).1Freedom of Information (Scotland) Act.
