Regulations 30 Regulations 40 (1) Any power conferred by this Act on the Scottish Ministers to make regulations includes the power to make— (a) different provision for different purposes, and UK Withdrawal from the European Union (Legal Continuity) (Scotland) Bill 25 Part 6—General and final provisions (b) such incidental, supplementary, consequential, transitional, transitory or saving provision as the Scottish Ministers consider necessary. (2) This section does not apply to regulations under section 36. 31 Scrutiny of regulations in urgent cases 5 (1) Subject to subsection (1A), subsection (2) applies to— (a) regulations to which section 7(5), section 14(1), section 21(1) or section 32(3) apply, or (b) regulations to which section 14(3) applies which would not otherwise be made without being subject to the affirmative procedure. 10 (1A) Subsection (2) does not apply to regulations under section 13(1). (2) The regulations may be made without being subject to the affirmative procedure if the regulations contain a declaration that the Scottish Ministers consider that, by reason of urgency, it is necessary to make the regulations without being subject to that procedure. (3) Regulations made in accordance with subsection (2) must be laid before the Scottish 15 Parliament as soon as practicable after they are made. (4) Regulations made in accordance with subsection (2) cease to have effect at the end of the period of 28 days beginning with the day on which they are made unless, during that period, the regulations are approved by resolution of the Scottish Parliament. (5) In calculating the period of 28 days, no account is to be taken of any period during 20 which the Scottish Parliament is— (a) dissolved, or (b) in recess...
