Exceptions include: o Houses and gardens o Other buildings o School grounds o Most land where crops are growing o Places which charge for entry , • These rights and responsibilities are detailed in the Outdoor Access Code which also sets out clearly where access rights do not apply, what to do if you encounter irresponsible behaviour, and potential statutory criminal offences. • The first port of call for questions about specific issues, or problems , who uphold access rights and should be local authority access officers facilitate access in each local authority and national park. • Scottish Government research about attitudes to land reform, published in March 2021, found that 56% of respondents were confident about their rights to access different types of land, with 42% not confident.

The Committee requests details of the information requested in that letter, and in particular— 1 o Details of the broader exclusion that the Scottish Ministers had sought and the impact of it not being agreed; o Clarity regarding whether the Scottish Government’s policy delivery of the ban on single use plastics has been slowed; o Why the framework has not yet been published and when it will be published; o Whether there have been any inter-governmental discussions on the exclusion outwith the framework. • Regarding the development of the exclusion, the Committee also seeks details of— o the process for agreeing the scope of the exclusion; o who was involved in the discussions; o if there were any disagreements on the proposed exclusion (in addition to the disagreement on the breadth of the exclusion referred to above) and how they were resolved; and o What further engagement is planned to ensure stakeholders are aware of the exclusion.
