To ask the Scottish Executive whether there are any proposals to make professional indemnity insurance a condition of registration for independent midwives.
Answer
Theregulation of midwives is a reserved matter. The Nursing and Midwifery Council,which is responsible for the regulation of all nurses and midwives, is a UKbody set up by Parliament under the Nursing and Midwifery Order (2001).
It is UK government policy that, through time, regulatedpractising healthcare professionals will be required to have adequate andappropriate indemnity cover as a condition of registration and continuedregistration with their professional bodies. This is already in place for anumber of the health professions, including doctors, dentists, osteopaths,chiropractors and opticians. The timescale for the legislation needed to applythis new requirement to midwives has not yet been agreed.

To ask the Scottish Executive how many clerks to the district court spend an insufficient percentage of their time on district court work to entitle them to transfer to employment with the Scottish Court Service under the Transfer of Undertaking (Protection of Employment) (TUPE) regulations.

According to the informationprovided so far by local authorities there are 28 district court clerks (legal assessors)who will meet the 50% criterion for time spent on district court business whichwould identify them as candidates for transfer to the Scottish Court Service. Three local authorities have not yet identifiedthe staff who meet this criterion, and there will be further discussions with localauthorities and their staff as preparations for courts unification are taken forwardin each sheriffdom.

To ask the Scottish Executive why the number of adults registered with NHS dentists in the East Kilbride constituency has fallen between 2005 and 2006.

General dental practitionersare independent contractors who are free to choose whether to join the dental listof an NHS board and whether to provide NHS dental treatment to each individual patient.Patient registrations can be withdrawn for a number of reasons including the dentistmoving to another area or retiring, non-payment of charges by the patient, the patientallowing their registration to lapse, or entry into a private arrangement.
