To ask the Scottish Executive what procedures NHS Lanarkshire follows in relation to concerns raised with an MSP about the medical treatment of a patient who has died without a next of kin.

NHS Lanarkshire have confirmed that they operate their formal complaints policy in line with the national guidance and relevant legislation.

Revised national guidance on “Handling and Learning from Feedback, Comments, Concerns and Complaints about NHS Health Care Services” was issued on 28 March 2012 under CEL 8 (2012). In cases relating to a patient who has died, Paragraph 4.5.5 of the guidance – “adults who cannot give consent” – would apply:

“Where a patient is unable to give consent the NHS organisation can agree to investigate a complaint made on their behalf by a third party. However, before doing so they should satisfy themselves that the third party has:

No conflict of interest

A legitimate interest in the patient’s welfare, for example if they are a welfare attorney acting on behalf of an individual covered by the Adults with Incapacity Act (2000)”.
