To ask the Scottish Executive whether wrongfully-convicted persons and their families would be entitled to any compensatory payment following release from prison.

Section 133 of the Criminal JusticeAct 1988 provides that compensation shall be paid in cases where a conviction hasbeen reversed on the ground that a new or newly discovered fact shows beyond reasonabledoubt that there has been a miscarriage of justice. The payment will be paid tothe person who has suffered punishment as a result of such conviction, or, if heis dead, to his personal representatives, unless non-disclosure of the unknown factwas wholly or partly attributable to the person convicted.

In addition, ministers may beprepared to make an ex gratia payment of compensation following a wrongfulconviction or charge where this has resulted from serious default on the part ofa member of a police force or some other public authority. There may also be exceptionalcircumstances that justify compensation in cases outside these categories.
