To ask the Scottish Executive, in light of the introduction of the European working time directive, how it plans to deal with any shortfall in the hours of junior doctors.
Answer
Compliance with the reduction in working hours is the responsibility of NHS boards as employers, as is the implementation of a range of measures to cover the hours previously worked by junior doctors.
At the request of Scottish ministers all NHS boards have provided information on how they plan to achieve compliance with Working Time Regulations (WTR). The Scottish Government continues to support NHS boards as they invest in rota and service redesign and workforce modernisation. The creation of new and extended non-medical roles, the new contract for SAS (Staff and Associate Specialist) Grade doctors and the introduction of the Hospital at Night concept are all ways which will help the boards to reduce their reliance on junior doctors for service delivery.

To ask the Scottish Executive what action it is taking to deal with retailers selling alcohol to under-18s.
Answer
We are currently implementing the Licensing (Scotland) Act 2005. This contains broad new powers to allow tough action to be taken against those who sell alcohol to children. The act comes fully into force on 1 September and we encourage licensing boards to use their new powers to crack down on rogue retailers.
The law in respect of underage sales is also being enforced. Test purchasing is an early success story, helping the police in their efforts to stop underage sales. The number of reports to procurators fiscal in respect of the sale of alcohol to under 18s has also increased significantly from 252 reports in the six months to September 2007 to 394 reports in the six months to March 2008.

To ask the Scottish Executive what it anticipates would be the impact of any new nucleic acid blood testing system in the Scottish National Blood Transfusion Service (SNBTS) on current arrangements for SNBTS testing of blood products from Northern Ireland.
Answer
The Scottish National Blood Transfusion Service has informed the Northern Ireland Blood Transfusion Service of its intention to enter into a joint tender with England and Wales for a state of the art nucleic acid testing system. The Northern Ireland Blood Transfusion Service has advised they would wish the current testing arrangements to continue, subject to contractually agreed periodic review processes.
