To ask the Scottish Executive, further to the answer to question S3W-7521 by John Swinney on 13 December 2007, whether the determination of the planning application on the proposed Trump development, now that it has been called in, will specifically consider the extent to which it contributes towards or detracts from the target of reducing greenhouse gas emissions by 80% by 2050 as a relevant material consideration.

To ask the Scottish Executive what assessment has been made of the effectiveness of the Code of Practice on Sewerage Nuisance.
Answer
The Scottish Odour Steering Group,which produced the code, continue to monitor its compliance and effectiveness. Thegroup is chaired by officials from the Scottish Government with membership drawnfrom Scottish Water and local authorities.
The group also implemented aweb based Odourhub in August 2007 to validate complaints submitted to local authoritiesagainst those submitted to Scottish Water.
The group will also undertakea formal evaluation of the code’s effectiveness in August 2008.

To ask the Scottish Executive whether the regeneration of the Clydebank riverside will remain a national priority for the enterprise network.
Answer
Discussions areunderway about the transfer of local regeneration activities between ScottishEnterprise and local authorities in line with recent reforms. However, nodecisions have been made on the status of individual projects, such as theClyde Waterfront or Clydebank Re-built Urban Regeneration Company. These willbe made shortly and stakeholders will be informed as soon as possible.
Where formalScottish Enterprise funding commitments exist for approved projects, these willbe honoured.

To ask the Scottish Executive whether it will list the odour ratings of each site at which sewerage odour nuisance has been recorded since the introduction of the Code of Practice on Sewerage Nuisance.
Answer
No. The odour ratingformula included in the Code of Practice is a tool to assist operators and regulatorsassess whether an odour nuisance may exist. It is not designed to determine accuratelyodour nuisance, which is the responsibility of the local authority EnvironmentalHealth Officer.

The Code of Practiceon Sewerage Nuisance came into force on 22 April 2006.There were 759 complaintson odour in 2006-07 and there have been 596 odour complaints in 2007-08 to date.

To ask the Scottish Executive whether Scottish Water met all required compliance dates for the Code of Practice on Sewerage Nuisance.
Answer
The Scottish Government
are monitoring Scottish Water and their PFI operators compliance with the Codethrough the Scottish Odour Steering Group, and can advise the vast majority of requiredcompliance dates have been met, and the remaining two requirements are being progressed.
The compliance with regulatory deadlines is as follows:
