To ask the Scottish Executive whether the Lord Advocate or any department within the Crown Office have been consulted on the proposed Stirling to Alloa Rail link and, if so, on what dates and for what reasons.
Answer
It would be inappropriate for the Executive to provide information which would harm the frankness and candour of discussion and advice, including between the Scottish Executive and legal advisers.

To ask the Scottish Executive on what date and by whom it was first informed that Railtrack plc was being considered for administration.
Answer
The Scottish Executive has been in regular contact with the Department of Transport, Local Government and the Regions on a wide range of issues, including the decision to place Railtrack plc into administration, and regular contact continues on issues arising from that decision.

To ask the Presiding Officer, further to the answer to question S1W-19992 by Lewis MacDonald on 11 December 2001, whether any aspects of the trunk road maintenance contracts have been varied or altered since 1 April 2001; if so, what variations have been made; whether the Executive has permitted Amey Highways Ltd and BEAR Scotland Ltd to make direct contact with the media without alteration to their respective contracts, and, if so, who gave authorisation for such direct contact to be made.
Answer
There have been a limited number of relatively minor changes to the trunk road maintenance contracts since 1 April 2001. The one alteration to the specification resulted from a requirement of the Scottish Executive to enhance the quality of driver information feeding into its National Driver Information and Control System (NADICS). In respect of the provisions dealing with media contact, revised procedures were agreed in writing between the Executive's Director of Road Network Management and Maintenance Division, BEAR Scotland Ltd and Amey Highways Ltd and were put in place in October 2001.

To ask the Scottish Executive whether developments reported in The Courier on 6 December 2001 in respect of Bear (Scotland) Ltd and Fife Council will have any impact on delivery of contracted provisions for winter under the trunk roads maintenance contract and what action it has taken to ensure that no disruption will occur.
Answer
BEAR Scotland Ltd has mobilised sufficient resources to address the winter and other maintenance operations previously carried out by Fife Council on BEAR's behalf. BEAR has assured the Executive that no disruption to services will occur.

To ask the Scottish Executive whether any difficulties exist between BEAR (Scotland) Ltd and Fife Council, when it first became aware of any such difficulties and what action it has undertaken to resolve them.
Answer
The Scottish Executive was not aware of any difficulties between BEAR Scotland Ltd and Fife Council until 29 November 2001 when it was advised that Fife Council was withdrawing its sub-contracting operations, including winter operations, for BEAR with effect from 7 December 2001. Executive officials immediately contacted BEAR to identify the measures that required to be implemented in order to address the operations previously undertaken by Fife Council. These measures have been implemented and BEAR are now carrying out all winter and other operations previously sub-contracted to Fife Council.
