To ask the Scottish Executive, further to the answer to question S1W-25982 by Mr Jim Wallace on 29 May 2002, whether it is the policy of the Scottish Prison Service to move to another prison a prisoner that has been involved in (a) an assault or (b) a serious assault on an officer and whether any such policy would apply to HM Prison Kilmarnock.
Answer
I have asked Tony Cameron, Chief Executive of the Scottish Prison Service to respond. His response is as follows:A prisoner is not automatically moved to another prison following an assault or a serious assault. Each case is considered individually depending on the circumstances. This applies to every prison in Scotland, including HM Prison Kilmarnock.

No, because the comparable private sector option excludes escorts.

Answer
The Scottish Executive supports the objective of the framework decision: that racist and xenophobic crime should be punishable by effective, proportionate and dissuasive criminal penalties.

To ask the Scottish Executive what impact the European Union framework decision on combating corruption in the private sector will have on Scots law.
Answer
The draft framework decision on combating corruption in the private sector seeks to harmonise member states' legislation relating to corruption in the private sector by establishing common offences and penalties to be adopted by member states. The Scottish Executive is studying the draft framework decision to determine what the implications might be for Scotland.

To ask the Scottish Executive what its position is on the draft European Union framework decision on the confiscation of crime-related proceeds, instrumentalities and property.
Answer
The provisions of the draft framework decision on the confiscation of crime-related proceeds, instrumentalities and property, if adopted, will be implemented as required throughout the UK as part of the UK's international obligations. However, in Scotland, the implementation would take account of the distinctive Scottish legal system.

Negotiations within the European Union on the draft framework decision on combating corruption in the private sector are being conducted by the UK Government, taking due account of the views of the devolved administrations. The Scottish Executive is in regular contact with the UK Government on a wide range of issues, including the draft framework decision.
