To ask the Scottish Executive, further to the answer to question S1W-22602 by Mr Jim Wallace on 14 February 2002, how many High Court cases in (a) Scotland and (b) each court have been postponed on the day of commencement due to technicalities or other reasons and what the estimated cost was resulting from such postponements in each case in (i) 2001-02 and (ii) 2002-03 to date.
Answer
As I explained in the answer given to question S1W-22602 on 14 February 2002, the information is not available in the form requested. All answers to written parliamentary questions are available on the Parliament's website, the search facility for which can be found at: http://www.scottish.parliament.uk/webapp/search_wa. Postponement of cases in the High Court is a statutory procedure which takes place before the start of a trial and no statistics of such postponements are collected. However, the following table sets out the number of indictments registered in the High Court for 2001-02 and 2002 to 31 August 2002, the number of cases which had a plea of guilty tendered before evidence was commenced, the number of cases which proceeded to have evidence led, and the balance of cases which did not proceed either prior to, or on the day of trial, for a variety of reasons. These reasons may include cases not proceeding due to witness unavailability, not called in court or deserted by the Crown, or cases where a warrant is issued for the accused among other things. No information on the costs of postponements is collected.

To ask the Scottish Executive what percentage of the cost of civil court business, including judicial costs, was recovered by the Scottish Court Service through fees in each financial year since 1998-99.
Answer
The information requested is contained in the following table. The cost estimates for 2000-01 were affected by changes in the capital charges applying to the Scottish Court Service. The allocation of these charges was the subject of review and adjustments made in 2001-02. The basis of cost allocation is audited by external auditors annually.

To ask the Scottish Executive why the number of proceedings taken by procurators fiscal in cases of vandalism fell as a proportion of cases cleared up by the police between 1997 and 2000.
Answer
I am not aware that the number of proceedings fell as the member suggests. Vandalism in police and Scottish Executive recorded statistics is defined as including malicious mischief, vandalism and reckless conduct with firearms. Prosecution policy in such cases remains that proceedings will be taken where there is sufficient evidence and it is in the public interest to do so.

Answer
I have asked Tony Cameron, Chief Executive of the Scottish Prison Service (SPS) to respond. His response is as follows:Approved activities were introduced into targets for the SPS from the year 2002-03. The target for the current year 2002-03 is a joint one for programmes and approved activities. The approved activities element is currently set at 400.

To ask the Scottish Executive, further to the commitment given by the Deputy First Minister and Minister for Justice to the Justice 1 Committee on 6 June 2002 (Official Report, col 3821) to reflect on the idea of a not-for-profit trust to own and operate new prisons and to consider whether it could be taken forward, what conclusion the Minister has reached.
Answer
I have asked Tony Cameron, Chief Executive of the Scottish Prison Service (SPS) to respond. His response is as follows:The announcement on 5 September of the Executive's decisions on the Prison Estates Review included a statement that in seeking tenders for the new prison to be built and operated by the private sector innovative proposals to provide care and opportunities for those on remand would be sought, and that those proposals could include a role for voluntary and charitable not-for-profit organisations. So far as the actual ownership and operation of a new prison is concerned, further consideration has not identified any examples of the use of a not-for-profit trust to own and operate a new prison that can be used to assess whether it would be viable in the Scottish context. In addition, there are significant concerns as to whether such a trust could be adequately funded on a long-term basis in a way that would deliver the necessary degree of transfer of risk to the operator and so keep the new prison off the SPS's balance sheet. However, if a serious not-for-profit proposal were submitted that could be shown to be robust and capable of delivering value for money and effective transfer of risk such a proposal would be considered.

To ask the Scottish Executive how many applications have been made in the Perth and Kinross Council area to date under its central heating installation programme; how many of these applications have been approved, and how many have now been carried out.
Answer
Perth and Kinross Council tell us they have no stock which lacks central heating. All housing association stock in the area has central heating. Eaga manage the central heating programme for owner-occupiers and private renters. They do not collect information by local authority area. Since the programme began Eaga have had 996 applications from the KY and PH postcode areas. To date they have approved 773 of them for initial survey and 300 heating systems have been installed.
