To ask the Scottish Executive which primary schools in Aberdeen City have had occupancy rates of 101% or more in the most recent year for which information is available.
Answer
In School Estate Statistics 2009, capacity information was available for 48 of the 50 primary schools in Aberdeen City. Of the 48 primary schools, 1 (2%) was operating at 100 per cent or more capacity. This primary school was:

In School Estate Statistics 2009 of the 17 secondary schools in Aberdeenshire, eight (47%) were operating at 100 per cent or more capacity. These secondary schools are:

To ask the Scottish Executive what additional capacity to help reduce waiting times will be created when the Scottish Regional Treatment Centre is taken into full NHS control.
Answer
The government is committed to increasing capacity in the NHS and treating patients as quickly as possible. Returning the Scottish Regional Treatment Centre to NHS control from the independent sector will help to achieve this.
NHS Tayside, NHS Fife and NHS Grampian are currently finalising a business case for the NHS-run Scottish Regional Treatment Centre which we expect to start operating in January 2010. The business case will explore future activity and capacity requirements. The boards aim to submit it to me before the end of November.

To ask the Scottish Executive what advice it has given to local authorities regarding regulations under section 6(1) of the Allotments (Scotland) Act 1892.
Answer
Within the last year, advice has been given in response to queries from two local authorities. Aberdeen City Council asked about rent levels for allotments in its area. The advice given was that this was a matter for the council. The City of Edinburgh Council asked about the process attaching to the confirmation of allotment regulations prepared by the council. The advice given explained the process.

To ask the Scottish Executive whether a local authority needs to formally make a regulation under section 6(1) of the Allotments (Scotland) Act 1892 before being able to charge or increase rent for allotments.
Answer
A local authority may make regulations under Section 6(1) of the Allotments (Scotland) Act 1892 as regards the letting of allotments, but the legislation does not compel them to do so.
