In relation to SSI 2023/364, does the committee wish to draw its correspondence with the Scottish Government to the attention of the Criminal Justice Committee, as it provides further information on how the instrument delivers the policy intention, and on factors that are relevant to the Scottish Government’s consideration of the compliance of the instrument with convention rights?

Members indicated agreement.

In relation to SSI 2023/366, does the committee also wish to draw its correspondence with the Scottish Government to the attention of the Criminal Justice Committee, as that correspondence and the revised policy note that resulted from the correspondence clarify the policy intention?

Members indicated agreement.
