The National Carers Strategy sets out actions on COVID-19 recovery, the cost crisis and improving carer support in a meaningful and sustainable way. The strategy focuses on carers and their needs, setting out how policies across the Scottish Government can work together with other public bodies to support carers as we recover from the pandemic and beyond.

The Scottish Government will deliver a statement to parliament in the new year, subject to the agreement of the Parliamentary Bureau.

We have been clear since the introduction of our emergency legislation that we would work with the social rented sector to seek an agreed way forward as an alternative to the continuation of the rent cap in the social rented sector beyond March 2023. To support this we have been working with a range of social rented sector organisations including landlord representative bodies COSLA, the Scottish Federation of Housing Associations and Glasgow and West of Scotland Forum of Housing Associations.

Statements of Intent have now been published by COSLA, confirming local authorities’ commitment to keeping rent increases in April 2023 to an average of no more than £5 a week, and by the Scottish Federation of Housing Associations, who report that their members are consulting with tenants on a set of increases in April 2023 that will average 6.1%.

The agreement to set out average figures, rather than set a fixed cap, allows flexibility for landlords to respond to their consultations with their tenants.

While we anticipate that many rents will be increased at a level below these average figures, there may be some social sector landlords who will for specific reasons go beyond this level, for example to allow planned improvements or maintenance to proceed.

This will allow for the statutory tenant consultations currently taking place to be taken into account for housing associations’ business plans and local authorities’ housing revenue accounts.

No social landlord is consulting on a rent increase at or above CPI inflation, which was 11.1% at the time of the data being collected.

Given the voluntary agreements reached we anticipate that the first statutory report on the Cost of Living (Tenant Protection) Act 2022, due by 14 January, will formally confirm our intentions to expire the social rented sector rent cap provisions from March 2023.

We are confident in local authorities’ ability to deliver unpaid work and other community orders but we recognise the huge impact which the pandemic had on justice social work and the ongoing efforts to ensure an effective and sustainable recovery.

We continue to work with key partners including Social Work Scotland, COSLA, and Community Justice Scotland to monitor recovery work, including measuring the level of outstanding unpaid work hours regularly and exploring any issues arising.

At present, management information indicates that the number of outstanding unpaid work hours across Scotland is close to pre-pandemic levels, at around 720,000 hours in November 2022 compared to around 690,000 hours in April 2020. Having some outstanding hours in the system is normal, as it takes time for individuals to undertake the unpaid work they have been sentenced to.

The ongoing recovery work is also supported through the draft budget for 2023-24, which maintains the additional funding of £15m provided in 2022-23 for justice social work services.

The policy position reflects our commitment to climate change and a town centre first approach, which includes the policy principle of limiting out of town development. The consultation analysis noted that some respondents raised particular issues about drive-throughs, including suggestions that their development must be limited to prevent the cumulative effects of carbon emissions by vehicles. This reflects the need to deliver a cut to carbon emissions by car, as well as reduce kilometres travelled by car by 20% by 2030, in line with wider Scottish Government policies and commitments. On this basis, a strengthened approach has been taken to promote a plan-led approach to drive-through developments.

As I set out in my answer to question S6W-12387, the Scottish Government has honoured the commitment I made during my visit on 3 November 2021 to provide financial support to Dumfries and Galloway Council. This included £25,000 of capital support, which represents half of the Council’s additional expenditure, in relation to the reinstatement of both the pedestrian river footbridges.

Circularity Scotland Ltd, as Scheme Administrator, is responsible for anti-fraud arrangements for Scotland’s Deposit Return Scheme (DRS).

When DRS launches on 16 August 2023, SEPA will become the enforcement authority for DRS. As part of this, SEPA will carry out audits, inspections and enforcement activity in relation to the obligations and offences contained within the regulations.

Policy 27 (d) represents a strengthening and restructuring of the policy consulted on in Draft NPF4. In the Draft NPF4 (Policy 26(a)), we consulted on restricting drive-throughs in out of town locations and, in response to what consultees told us and through our broader strategy of transitioning to net zero, the policy has been restructured in a more tightly worded policy in the Revised Draft. The changes maintain the policy intent, while reflecting responses to the consultation. Given this and the extent of engagement, consultation and scrutiny already undertaken, and the fact that we are engaging further, and will continue to do so as we enter the delivery phase of NPF4, no further consultation was required.

The Scottish Government is committed to investing in Changing Places Toilets over this parliamentary term, in order to increase the number of these facilities across the South Scotland Region and country and to support mobile Changing Places Toilets to allow people easier access to events and outdoor venues.

Funding for the construction of Changing Places Toilets has not yet been allocated. We are progressing the first phase of work in order to design an investment programme that ensures that the Changing Places Toilets which are built are fit for purpose. Further information about this fund will be available next year. The work to replace and upgrade the security equipment across the Scottish Government estate is part of a multi-year improvement programme, and is therefore subject to the usual resourcing and prioritisation variables, common with such large-scale programmes.

It is not in the public interest to publicise details of the Scottish Government’s physical security across its estate, however I can confirm that all Hikvision CCTV cameras have been replaced at those Scottish Government buildings identified as “sensitive sites”, as described in the recent UK Government statement.

The analysis referred to was carried out by independent contractors, rather than internally by the Scottish Government. The approach of recording ‘yes’, ‘no’ and ‘no response’ was followed throughout the analysis for all of the questions asked by the consultation. Accurately representing ‘no response’ answers alongside the other options available reflects that some respondents to the full consultation may not have held views on certain areas, or may have had mixed views that did not fall into the ‘yes’ or ‘no’ response categories. Most of those who answered Question 31 were in favour of changing the legislation.
