To consider and report on health policy, the NHS in Scotland, anti poverty measures, equalities, sport and other matters falling within the responsibility of the Cabinet Secretary for Health, Wellbeing and Cities Strategy apart from those covered by the remit of the Economy, Energy and Tourism Committee.

Subordinate Legislation

The Committee reports to the Parliament as follows—

The National Health Service (Superannuation Scheme and Pension Scheme) (Scotland) Amendment Regulations 2012 (SSI 2012/69)

1. The National Health Service (Superannuation Scheme and Pension Scheme) (Scotland) Amendment Regulations 2012 (SSI 2012/69) was laid before the Parliament on 1 March 2012. The instrument is subject to negative procedure.

2. The instrument amends the National Health Service Superannuation Scheme (Scotland) Regulations 2011 (SI 1995/117 “the 1995 Section of the scheme”) and the National Health Service Pension Scheme (Scotland) Regulations 2008 (SSI 2008/224 “the 2008 Section of the scheme”).

3. The Health and Sport Committee took oral evidence on the SSI from Nicola Sturgeon, Cabinet Secretary for Health, Wellbeing and Cities Strategy at its meeting on 27 March 2012.1

4. The Committee noted that the Subordinate Legislation Committee had not drawn the instrument to the Parliament’s attention2.

5. A motion to annul the instrument was lodged by Drew Smith MSP on 10 April 2012.

6. At the Health and Sport Committee meeting on 17 April 20123, Drew Smith MSP moved motion S4M-02588—

That the Health and Sport Committee recommends that the National Health Service (Superannuation Scheme and Pension Scheme) (Scotland) Amendment Regulations 2012 (SSI 2012/69) be annulled.

7. Following debate, with the agreement of the Committee, the motion was withdrawn.
