Ahead of the UK's withdrawal from the European Union, the Scottish Government has written to the Finance and Constitution Committee and the Delegated Powers and Law Reform Committee of the Scottish Parliament outlining its approach to affording Parliament the opportunity to scrutinise proposals to consent to the UK Government legislating in devolved areas. The Scottish Government and the Scottish Parliament have agreed a protocol for notification of Parliament of Scottish Government proposals. The Committee received a notification from the Minister for Business, Fair Work and Skills on Insolvency (Amendment etc.) (EU Exit) Regulations 2018 on 20 September 2018.

On 1 October the Committee received a briefing from R3, the insolvency and restructuring trade body. R3 also provided a briefing paper on the potential impact of Brexit on the UK’s insolvency and restructuring framework.

The Committee considered the consent notification on 2 October and took evidence from Scottish Government officials.

The Minister wrote to the Committee on 7 November 2018, advising the committee that there will be a delay in laying the regulations and expect that they will be laid on 15 November 2018.

The Minister wrote to the Committee on 27 November 2018 and confirmed that the Scottish Government is content that the SI is drafted in a manner which is consistent with the consent granted.
