I think that, when we say that an instrument is defectively drafted, that is more to do with the fact that procedures have not been followed, as opposed to there being a question of clarity of meaning.

The best action to take is the action that I have just announced, which is to ensure that people will not be required to sign a waiver. Following discussions yesterday, the Minister for Health and Community Care and I have agreed to withdraw that particular document and to ensure that new guidance is circulated to those affected.
