I would like to ask you a broader question that perhaps goes beyond the code. The code is formulaic, in that it details the procedures and so on that must be followed.
A key part of this exercise will involve consultation on the Code of Audit Practice in February 2026 with a view to a new Code being published in June 2026.

We wonder if it would be better to define what a field is as common grazing may be a significant area which may or may not be enclosed. The Scottish Outdoor Access Code (the Code) refers to being “under close control”.
The purpose of the Bill was to improve the position of tied pub tenants by requiring the establishment of a Scottish Pub Code to govern the relationship between pub-owning businesses and their tied tenants and ensure the appointment of a Scottish Pubs Code Adjudicator to apply the code.
We have seen a case come before the tribunal in which the complainant was not even the homeowner, although the code of conduct under the 2011 act is very specific on that.
Clarification of the point raised by the commissioner is a matter for guidance, but my officials will work with him on a code of practice that will clarify such issues.
