SB 10-73 Double Jeopardy (Scotland) Bill

The current common law rule against double jeopardy generally prevents someone from being tried twice for the same crime. The Bill seeks to reform that rule and restate it in statute. This briefing includes consideration of: (a) the current common law rule; (b) work undertaken by the Scottish Law Commission on the topic; and (c) the proposals in the Bill.
