SB 09-38 Criminal Justice and Licensing (Scotland) Bill : Disclosure of Evidence

The Criminal Justice and Licensing (Scotland) Bill includes provisions to establish a statutory framework for the disclosure of evidence in criminal cases. The framework provides for disclosure by the prosecution to the accused. This briefing looks at: (a) the work undertaken by Lord Coulsfield (a retired High Court judge) in reviewing the law and practice of disclosure of evidence in criminal cases; and (b) the proposals in the Bill on disclosure of evidence.
