The Standing Orders of the Scottish Parliament require allbills on introduction to be accompanied by a Financial Memorandum which sets out the best estimatesof the administrative, compliance and other costs to which the provisions of thebill would give rise, best estimates of the timescales over which such costs wouldbe expected to arise, and an indication of the margins of uncertainty in such estimates.The Financial Memorandum must distinguish separately such costs as would fall upon(a) the Scottish administration, (b) local authorities and (c) other bodies, individualsand businesses. These memoranda are freely available on the Scottish Parliament’swebsite.

The Financial Memorandum to theBill is available on the Scottish Parliament’s website. The only quantifiable costsarising from provisions in the bill relate to the operation of the office of theCommissioner for Children and Young People. These costs are the responsibility of the Scottish Parliament Corporate Body.

An Estimate of Expense and FundingStatement was not required to accompany the bill. The act follows a Private Billand the Executive holds no information about any related costs incurred by the promoterof the bill since the act came into force.

The Financial Memorandum to thebill is available on the Scottish Parliament’s website. The only costs incurredup to the end of 2005-06 that are attributable directly to the provisions in theact have fallen on the running costs of the Scottish Environment Protection Agency.These costs amounted to some £3.8 million in 2005-06. The provisions in the actthat would result in costs falling on other organisations only came into force inApril this year. Annual costs falling on these organisations are not therefore availableyet.

Answer
The National Galleries of ScotlandAct 2003 followed a Private Bill introduced by the Board of Trustees of the NationalGalleries of Scotland. As such, a Financial Memorandum was neither requiredas part of the legislative process nor prepared. The Executive has no direct locusin the Parliamentary procedures for Private Bills and holds no information aboutany costs incurred in relation to this act.
