Instruments subject to Affirmative Procedure
Agenda item 2 is consideration of the following two affirmative instruments.
Roads (Scotland) Act 1984 (Environmental Impact Assessment) Regulations 2017 [Draft]
Transport and Works (Scotland) Act 2007 (Environmental Impact Assessment) Regulations 2017 [Draft]
Both instruments were initially laid before Parliament, in draft, on 8 March 2017. Subsequent to that, the committee’s legal advisers identified some drafting inconsistencies and minor errors in both of the instruments. Accordingly, they were withdrawn by the Scottish Government, and relaid on 23 March 2017 with the errors identified having been corrected.
No points have been raised by our legal advisers on the relaid instruments. Is the committee content with them?
