Civil Partnership (Scotland) Act 2020 (Commencement No 3, Saving and Transitional Provision) Regulations 2021 (SSI 2021/23)

Agenda item 2 is consideration of subordinate legislation. The first instrument for consideration is the Civil Partnership (Scotland) Act 2020 (Commencement No 2) Regulations 2020 (SSI 2020/457). This Scottish statutory instrument commences aspects of the Civil Partnership (Scotland) Act 2020 and is before the committee for members’ reference only.

The second instrument is the Civil Partnership (Scotland) Act 2020 (Commencement No 3, Saving and Transitional Provision) Regulations 2021 (SSI 2021/23), which is subject to the negative procedure. I refer members to a paper by the clerk, which notes that the Delegated Powers and Law Reform Committee considered the regulations at its meeting on 26 January 2021 and noted that they had not been laid within the required timescales. In its report to the Parliament dated 29 January 2021, the DPLR Committee noted that it is content with the explanation that the Scottish Government provided for not meeting those timescales.
