The Carers (Scotland) Act 2016 (Adult Carers and Young Carers of Terminally Ill Persons: Timescales for Adult Carer Support Plans and Young Carer Statements etc.) Regulations 2021

CARERS (SCOTLAND) ACT 2016 (ADULT CARERS AND YOUNG CARERS OF TERMINALLY Ill PERSONS: TIMESCALES FOR ADULT CARERS SUPPORT PLANS AND YOUNG CARER STATEMENTS ETC.) REGULATIONS 2021

  1. The Carers (Scotland) Act 2016 (Adult Carers and Young Carers of Terminally Ill Persons: Timescales for Adult Carers Support Plans and Young Carers Statements etc.) Regulations 2021 [draft] were laid before the Parliament on 26 January 2021 and referred to the Health and Sport Committee.

  1. They are laid under the powers conferred by section sections 7, 8, 13 and 14 of the Carers (Scotland) Act 2016. The instrument is subject to affirmative procedure.

  1. At its meeting on 2 February 2021, the Delegated Powers and Law Reform Committee considered the instrument and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. It is for the Health and Sport Committee to recommend to the Parliament whether the Regulations should be approved.

  1. The Minister for Public Health and Sport has, by motion S5M-24035, proposed that the Committee recommends approval of the Regulations.

  1. At its meeting on the 23 February 2021, the Committee took evidence on the Carers (Scotland) Act 2016 (Adult Carers and Young Carers of Terminally Ill Persons: Timescales for Adult Carers Support Plans and Young Carer Statements etc.) Regulations 2021 [draft] from—

    • Mairi Gougeon, Minister for Public Health and Sport;

    • John Paterson, Solicitor and Deputy Director, Legal Directorate; and

    • Joanne Pierce, Policy Officer,Scottish Government.

  1. To inform the Committee's evidence session with the Scottish Government the Committee issued a targeted call for written views. A submission was received from Age Scotland and a joint submission provided by Marie Curie, Macmillan Cancer Support and the Scottish Partnership for Palliative Care.i

  1. Following the evidence session Mairi Gougeon , Minister for Public Health and Sport moved motion S5M-24035 —

    That the Health and Sport Committee recommends that the Carers (Scotland) Act 2016 (Adult Carers and Young Carers of Terminally Ill Persons: Timescales for Adult Support Plans and Young Carer Statements etc.) Regulations 2021 )[draft] be approved.
