PE01661: Reform of regulation of the legal profession in Scotland

Calling on the Scottish Parliament to urge the Scottish Government to reform and amend the regulation of complaints about the legal profession in Scotland, which is currently delegated to the Scottish Legal Complaints Commission, by creating a new independent regulator of legal services with powers equivalent to the Solicitors Regulation Authority, Legal Ombudsman, Bar Standards Board and Solicitors Disciplinary Tribunal which serve consumers and clients of legal service providers in England and Wales.

21 September 2017: The Committee agreed to join petitions PE1660 and PE1661 together for future consideration on the basis that they raise similar issues. The Committee also agreed to write to the Scottish Government, the Scottish Legal Complaints Commission, the Law Society of Scotland, the Faculty of Advocates, Scottish Solicitors' Discipline Tribunal, Citizens Advice Scotland and the Judicial Complaints Reviewer. 22 March 2018: The Committee agreed to defer further consideration of these petitions until the findings of the Independent Review of the Regulation of Legal Services are published. Link to the Official Report 22 March 2018

Written Submissions: 

Do you consider the current system of self-regulation of the legal profession where the Scottish Legal Complaints Commission action as the single gateway for all complaints about legal services does not serve the interests of consumers or the legal profession?

Do you agree that the Legal Profession & Legal Aid (Scotland) Act 2007 has not achieved any measurable reform to any of these issues, and is now widely seen by consumers as worsening consumer protection rather than enhancing it?

Do you believe we are all entitled to a measurably high standard of legal services, which everyone must at some point rely on in their lives, whether this be for civil or criminal law?

I urge anyone who feels Scotland’s legal services market and regulation of the legal profession could be enhanced by reform to the current system of self-regulation, to sign and support this petition.

Please help towards changing the law to help people of public victims of companies and have a fair balance where we can have help of the police too instead of just having to go to ombudsman. We are victims of business alike everyday! We sgould not be ignored as some of the actions can turn your life upside down and we have to spend months trying to sort things out where a lot of companies get off with too much! While if you where to be the one to cause any damage to the business theft etc the police are involved right away it becomes a crime right away and we are told to go and get legal advice its a civil matter. PLEASE SIGN TO CHANGE THIS LAW SO CONSUMER VICTIMS HAVE THE SAME RIGHTS AND TAKEN SERIOUSLY!!

I'd like to know why my domestic abuse divorce was dragged out by the ex constantly refusing what he was due, 13 long years 4 month of legal aid he had to continue his control, why did no one question it.

I think that parliament should do something about this as the system does not seem to work very well surely the slcc should stand up and admit their failings .
