PE01745: Statutory Right for Families to Request a Fatal Accident Inquiry

Petitioner: James Jones

Date Lodged: 16 September 2019

Calling on the Scottish Parliament to urge the Scottish Government to ensure that families have a statutory right to request a Fatal Accident Inquiry.

Should families be able to request a Fatal Accident Inquiry?

I wholeheartedly support this petition. A family member was failed by an NHS Board in October 2016. I had to petition to parliament for an inquiry (which is in progress), and the Crown Office is *still* deciding whether, "it is in the publics interest" to hold an FAI into the system defects which led to my family member being failed, ultimately leading to his death. We have been waiting for nearly 3 years for a response from COPFS. This adds further torture and trauma to an already traumatised family. When there are clear failings, there should be no excuses for COPFS to not hold an FAI.

I feel families should have the right to ask for a fai if they feel there loved one has been failed. My partner was failed after he was repeatedly turned away by the hospital, he went onto take his own life. I have repeatedly asked for a fai and been told his case does not fall under the rules and it not in the public best interests. I feel a fai would help prevent the same mistake from happen again and helping further generations.
